Terms governing your use of ViewPeek
These Terms of Use ("Terms" or "CGU") govern your access to and use of ViewPeek ("the Service"), available at https://viewpeek.com, operated by SASU Dynamic Foundries (RCS Paris 102 801 206) ("we", "us", "our").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
Paid subscriptions are additionally governed by our Terms of Sale (CGV), which detail pricing, billing, the right of withdrawal, the statutory warranty of conformity, consumer mediation, and the EU online dispute resolution platform.
About the Service
ViewPeek is a website monitoring service providing uptime monitoring, SSL certificate tracking, ping monitoring, and sitemap validation.
Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately at contact@dynamic-foundries.com if you suspect unauthorized use of your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
Free and Paid Plans
The Service offers both free and paid subscription plans. Paid plans provide additional features and higher usage limits.
- Plan details and pricing are available on the Service's pricing page.
- Paid plans are billed on a monthly basis, as selected during subscription.
- Payments are processed by Stripe Payments Europe Ltd. (Ireland), with technical transfers to Stripe, Inc. (United States) under the EU-US Data Privacy Framework. We do not store your payment card details on our servers.
Billing and Renewal
- Paid subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date.
- You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.
- No prorated refunds are provided for partial billing periods.
Right of Withdrawal and Refunds
Consumers benefit from a 14-day statutory right of withdrawal under Article L221-18 of the French Consumer Code. Because the Service is digital and provided immediately on subscription, the right of withdrawal and any prorata refund are governed in detail by section 4 of our Terms of Sale (CGV). Outside the statutory window, no prorated refund is provided for partial billing periods.
Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:
- Use the Service in any way that violates applicable laws or regulations
- Upload or transmit content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
- Upload malware, viruses, or any code designed to disrupt, damage, or limit the functionality of any software or hardware
- Attempt to gain unauthorized access to any part of the Service, other accounts, or systems
- Use the Service to send spam, phishing, or unsolicited communications
- Use automated tools (bots, scrapers) to access the Service beyond documented APIs
- Resell, sublicense, or redistribute the Service without our prior written consent
- Circumvent or attempt to circumvent usage limits, rate limits, or access controls
We reserve the right to suspend or terminate your account for violation of these terms, with or without prior notice.
Your Content
- You retain ownership of all content you upload, create, or transmit through the Service ("Your Content").
- By using the Service, you grant us a limited license to host, store, and process Your Content solely for the purpose of providing the Service to you.
- We do not access, review, or share Your Content except as necessary to operate the Service, comply with the law, or enforce these Terms.
- You are solely responsible for Your Content and must ensure it does not violate applicable laws or third-party rights.
Service Availability
- We strive to maintain high availability but do not guarantee uninterrupted service.
- Scheduled maintenance will be communicated in advance when possible.
- We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time.
- In the event of permanent discontinuation, we will provide at least 30 days' notice and allow you to export your data.
Intellectual Property
The Service, including its design, code, text, graphics, logos, and all related intellectual property, is the property of SASU Dynamic Foundries and is protected by French and international intellectual property laws. You may not reproduce, distribute, or create derivative works from the Service without prior written consent.
No Warranty
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
This clause does not affect the statutory warranty of conformity that consumers benefit from under Articles L224-25-12 et seq. of the French Consumer Code, which applies notwithstanding any "as is" disclaimer for paid subscriptions (see Terms of Sale, section 5).
Limitation of Liability
To the maximum extent permitted by applicable law, SASU Dynamic Foundries shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of data, revenue, or profits.
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount paid by you to us in the 12 months preceding the event giving rise to the claim.
This limitation does not apply to consumers within the meaning of the French Consumer Code, nor in cases of wilful misconduct (dol), gross negligence (faute lourde), breach of an essential obligation, or personal injury.
Account Termination
- You may delete your account at any time from your account settings.
- Upon deletion, your data will be removed within 30 days in accordance with our Privacy Policy.
- We may terminate your account if you violate these Terms, with notice sent to your registered email address.
- Upon termination, your right to use the Service ceases immediately.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Service at least 15 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
Consumer Mediation and Online Dispute Resolution
In accordance with Articles L612-1 and L616-1 of the French Consumer Code, consumers may refer any unresolved dispute concerning the Service to a consumer mediator, after first contacting our customer service in writing at contact@dynamic-foundries.com. The designated mediator for paid subscriptions is identified in section 7 of our Terms of Sale (CGV); the same mediator is available for disputes relating to the use of the free plan to the extent the mediator's scope permits.
European consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr, in accordance with EU Regulation 524/2013, Article 14.
Governing Law and Jurisdiction
These Terms are governed by French law. Any dispute arising from or related to the use of the Service shall be submitted to the competent French courts.
This clause does not deprive a consumer of the right to bring proceedings before the court of their place of domicile, in accordance with the rules of private international law (notably EU Regulation 1215/2012, Article 18).
