Terms of Sale / Conditions Générales de Vente
The contractual terms that govern paid subscriptions to ViewPeek.
These Terms of Sale ("CGV") govern the sale of paid subscriptions to ViewPeek ("the Service"), available at https://viewpeek.com, between SASU Dynamic Foundries (RCS Paris 102 801 206), registered office 15 Boulevard Saint-Marcel, 75013 Paris, France, and you ("the Customer"). The general use of the Service — free or paid — is governed by the separate Terms of Use.
By subscribing to a paid plan, you accept these CGV. If you do not agree, please do not subscribe.
1. Pre-contractual Information
In accordance with Article L221-5 of the French Consumer Code, the following information is provided before any subscription:
- Identity of the seller: SASU Dynamic Foundries, RCS Paris 102 801 206, share capital 1 EUR, 15 Boulevard Saint-Marcel, 75013 Paris, France. Email: contact@dynamic-foundries.com. VAT number: FR84102801206.
- Essential characteristics of the Service: website monitoring across four check types — HTTP/HTTPS uptime, SSL certificate expiry, ICMP ping reachability, and sitemap validation. Per-plan limits (number of monitors, sitemap pages, included team seats, and optional extra-seat pricing) are published on the pricing page and form an integral part of these CGV.
- Total price including all taxes: prices are displayed and charged in EUR, TTC (toutes taxes comprises) for French consumers — French VAT at the rate in force is included. Reverse-charge applies for VAT-registered EU B2B customers (VAT-exclusive invoicing on production of a valid intra-EU VAT number).
- Term of the contract: monthly. Subscriptions renew tacitly at the end of each billing cycle until cancelled. Annual subscriptions are not currently offered.
- Conditions of execution and complaint handling: the Service is delivered electronically via your account. Complaints may be submitted to contact@dynamic-foundries.com — we acknowledge within 5 business days and resolve within 30 days where possible.
2. Plans, Pricing, and Execution
- Plan details, prices, and per-plan limits (number of monitors, sitemap pages, included team seats, optional extra-seat pricing) are published on the pricing page and form part of the contract at the time of subscription.
- Subscriptions are billed in advance on a monthly basis. Payment is processed by Stripe Payments Europe Ltd. (Ireland), with technical transfers to Stripe, Inc. (United States) under the EU-US Data Privacy Framework. We do not store your payment card details on our servers.
- Service execution begins immediately upon successful payment, unless you have not waived your right of withdrawal under Article L221-28-13° (see section 4 below).
- Invoices are made available in your billing portal in PDF format and retained for 10 years (Article L123-22 of the French Code de commerce).
3. Renewal and Cancellation
- Paid subscriptions automatically renew at the end of each monthly billing cycle.
- You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period and prevents the next renewal.
- Outside the 14-day withdrawal window described in section 4, no prorated refund is provided for partial billing periods.
- Annual or pluri-annual subscriptions are not currently offered; the renewal-notice obligation of Article L215-1 of the French Consumer Code (loi Chatel) therefore does not apply at this time. Should we introduce subscriptions exceeding 12 months, this section will be updated to include the statutory advance renewal notice.
4. Right of Withdrawal
As a consumer, you have a 14-day right of withdrawal from the day you subscribe, in accordance with Article L221-18 of the French Consumer Code. To exercise this right, you must notify us of your decision to withdraw by an unambiguous statement (email to contact@dynamic-foundries.com or postal letter to our registered office). The statutory withdrawal form below may be used but is not mandatory.
Express request for immediate execution and waiver
Because the Service is digital and is provided as soon as the subscription is confirmed, the subscription flow asks you to expressly request immediate execution and to acknowledge that, in accordance with Article L221-28-13° of the French Consumer Code, you will lose the right of withdrawal once the Service has been fully provided. This consent is recorded with a timestamp and the version of these CGV in effect.
If you exercise your right of withdrawal during the 14-day period despite this express request, we will refund the amount paid for the subscription, less an amount proportional to the period during which the Service was made available (prorata temporis), in accordance with Article L221-25 of the French Consumer Code.
Statutory withdrawal form (Annexe à l'article R221-1)

This form is provided pursuant to the Annexe to Article R221-1 of the French Consumer Code.
5. Statutory Warranty of Conformity
Consumers benefit from the statutory warranty of conformity provided for in Articles L224-25-12 et seq. of the French Consumer Code (transposing Directive (EU) 2019/770 on digital services). This warranty applies notwithstanding any "as is" or "no warranty" clause in the Terms of Use. If the Service does not conform to the contract, you may obtain its bringing into conformity at no cost or, where bringing into conformity is impossible or excessively costly, a price reduction or termination of the contract. Claims under this warranty may be sent to contact@dynamic-foundries.com.
6. Liability
To the maximum extent permitted by applicable law, our total aggregate liability for any claims arising from or related to a paid subscription is capped at the amount paid by the Customer in the 12 months preceding the event giving rise to the claim.
This limitation does not apply to consumers within the meaning of the French Consumer Code, nor in cases of wilful misconduct (dol), gross negligence (faute lourde), breach of an essential obligation, or personal injury. In particular, the statutory warranty of conformity (section 5) and the right of withdrawal (section 4) apply notwithstanding any limitation in these CGV.
7. Consumer Mediation
In accordance with Articles L612-1 and L616-1 of the French Consumer Code, you may refer any unresolved dispute concerning a paid subscription to a consumer mediator, after first contacting our customer service in writing at contact@dynamic-foundries.com.
The designated consumer mediator and the URL for filing a request will be communicated upon request to contact@dynamic-foundries.com pending finalization of the mediation agreement. We commit to identifying the mediator on this page within a reasonable timeframe.
European consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr, in accordance with EU Regulation 524/2013, Article 14.
8. Personal Data
Personal data collected during subscription is processed in accordance with our Privacy Policy, which forms an integral part of these CGV.
9. Changes to These CGV
We may update these CGV from time to time. If we make material changes, we will notify you via email or through the Service at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised CGV. The version applicable to your subscription is the version in effect on the day of subscription.
10. Governing Law and Jurisdiction
These CGV are governed by French law. Any dispute arising from a paid subscription shall be submitted to the competent French courts.
This clause does not deprive a consumer of the right to bring proceedings before the court of their place of domicile, in accordance with the rules of private international law (notably EU Regulation 1215/2012, Article 18).
